2. Counter-Notice by Allegedly Infringing Party
If you believe material on the Site was removed or disabled in error, you may submit a counter-notice (the “Counter Notice”) in accordance with the DMCA. Your Counter Notice must include:
- Your Signature: A physical or electronic signature of the subscriber.
- Identification of Removed Material: A description of the material removed or disabled and its location before removal.
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
- Your Contact Information and Consent: Your name, address, and telephone number, along with a statement consenting to the jurisdiction of the Federal District Court in your location or, if outside the U.S., any jurisdiction where Intuit Mall operates. You must also agree to accept service of process from the original complaining party or their agent.

3. Intuit Mall’s Response to Notices and Counter Notices

Upon receiving a valid Notice, we will:
- Remove or disable access to the infringing material.
- Notify the user responsible for the material about the removal, providing a copy of the Notice.

Upon receiving a valid Counter Notice, we may:
- Forward the Counter Notice to the original complainant.
- Restore the removed material within 10 business days, unless the original complainant files legal action to prevent reinstatement.
Failure to comply with these requirements may result in invalidation of your Notice or Counter Notice.
4. Repeat Infringers
Intuit Mall reserves the right to terminate the accounts or access rights of users who are determined to be repeat infringers under applicable laws.
5. Misrepresentation and Liability
Under Section 512(f) of the Copyright Act, any person who knowingly misrepresents that material or activity is infringing, or that removed material was removed by mistake or misidentification, may be held liable for damages.
